Section 29: Penalties.

(1) Any person who does or omits to do any act, matter or thing, the doing of or omission to do which is an offence under this Act or any person who contravenes any of the provisions of this Act, the contravention of which is an offence under this Act, shall on summary conviction be liable to a fine not exceeding NI00 or to imprisonment for a term not exceeding 12 months or to both such fine and imprisonment.
(2) If the offence is a continuing one, any person who continues to commit the offence shall upon conviction for each day in respect of which the offence continues be liable to a fine not exceeding N10 or imprisonment for one month or both such fine and imprisonment.
(3) Where it is proved to the satisfaction of the court that any offence against this Act has been committed by a person in the employment of the holder of a lease or licence, the holder shall also be liable for the offence and penalty provided therefor unless he proves to the satisfaction of the court-
(a) that the offence was committed without his knowledge or consent; and
(b) that he had taken all reasonable means to prevent the commission of the offence, but nothing in this subsection shall be deemed to exempt the employee from the penalties provided for the offence committed by him.
