Section 35: Prohibition of construction or reconstruction by unauthorised persons or body corporate.

(1) A person or body corporate shall not commence construction or reconstruction of an aerodrome or airport in Nigeria without consultation with the Authority in line with its functions under this Act.
(2) Any person or body corporate that contravenes the provisions of subsection (1) commits an offence and is liable on conviction -
(a) in the case of an individual, to a fine not more than N2,000,000; or
(b) in the case of a corporate body, to a fine not more than N5,000,000.
