Section 36: Restoration order

The High Court may order that the tobacco, tobacco product or thing be restored immediately to the applicant if, the court is satisfied that-
(a)
the applicant is entitled to possession of the tobacco, tobacco product or thing seized; and
(b)
the tobacco, tobacco product or thing seized is not and will not be required as evidence in any proceeding in respect of an offence under this Act.
