Section 39: Trial in absentia

(1) The absence from Nigeria of a person accused of an offence under this Act shall not prevent his being tried and convicted under this Act.
(2) An order of the Tribunal made pursuant to a trial under subsection (1) of this section shall, where expedient, be executed on the person convicted, but the commencement of a sentence of imprisonment shall be deferred until his return to Nigeria.
