Section 45: Plant Breeders' Rights Development Fund.

(1) The Minister shall, after consultation with the Minister responsible for finance, establish the Plant Breeders' Rights Development Fund (in this Act referred to as "the Fund") into which money realised under this Act shall be kept.
(2) The sources of money for the Fund shall include:
(a) fees payable under this Act; and
(b) any donation or grant from the Government or any other person.
(3) The Fund shall be applied for:
(a) development and promotion of the plant breeders' rights;
(b) training of plant breeders on matters concerning plant breeders' rights;
(c) establishment and maintenance of variety collection and data base; and
(d) any other activity relating to administration of this Act.
(4) In addition to the functions entrusted to it under section 10 of this Act, the Committee shall operate as the Fund Committee, whereby:
(a) the Registrar shall be a member of the Fund Committee and shall serve as the Secretary of the Fund;
(b) the Fund Committee shall make rules and procedures for the operations and management of the Fund;
(c) separate books of accounts and other records in respect of the Fund shall be kept properly and maintained and be subject to audit.
