Section 41: Restrictions on the exercise of breeder's right.

(1) The free exercise of a breeder's right shall, unless where expressly provided in this Act, not be restricted for reasons other than of public interest.
(2) When any such restriction has the effect of the Registrar authorising a third party to perform any act for which the breeder's authorisation is required, the breeder shall receive equitable remuneration.
