HIV AND AIDS (ANTI-DISCRIMINATION) ACT
Section 8: Disclosure of HIV status
(1)
Prior to accessing any public or privately delivered services, employment and any other opportunity, no individual, institutions or bodies shall require a person to disclose his or her HIV status or the status of any other person, by asking questions, orally or in writing directly or indirectly.
(2)
Notwithstanding the provisions of this section, any partner in a marriage or co-habiting relationship has the right to be informed of his or her partner's HIV status in a situation where he or she considers himself or herself at risk of being infected by a partner.
