Section 11: Prohibition of disclosure of status without consent

(1)
No person shall, except with the written consent of the individual to whom the information relates, disclose any information relating to the HIV status ofthat individual unless the disclosure is required by law.
(2)
For the purposes of Section 11, a person or institution shall be deemed to have breached confidentiality where an individual who receives information about another individual's HIV positive status in the course of their relationship discloses such to a third party without the written consent of the HIV positive employee.
