Section 12: Anonymous HCT Testing not precluded
(1)
Nothing in the foregoing Sections shall preclude anonymous, unlinked surveillance or epidemiological HIV testing provided that such is undertaken in accordance with ethical and legal principles regarding such research and the information obtained shall not be used to discriminate against individuals or groups of persons.
(2)
Testing will not be considered anonymous if there is a reasonable possibility that a person's name or personal identifying features can be linked to the test.
