Section 26: Referral to Council

Where at any time the Agency is of the opinion that –(a) a project is likely to cause significant adverse environmental effects that may not be mitigable; or
(b)
public concerns respecting the environmental effects of the project warrant it,
the Agency may refer the project to the Council for a referral to mediation or review panel in accordance with section 35 of this Act.
