Section 28: Penalties.

(1) A person who commits an offence under this Act is liable-
(a) on summary conviction, to a fine not more than N250,000;
(b) on conviction or indictment to a fine not more than N250,000 or imprisonment for at least two years or both.
(2) Where an offence under this Act is committed by a body corporate, the chief executive officer, director, manager or secretary is liable to pay a fine of N200,000 each unless, having regard to the nature of his functions in that capacity and to all the surrounding circumstances, he proves that-
(a) the offence was committed without his knowledge, consent or connivance; and
(b) he had taken all reasonable precautions and exercised due diligence to prevent the commission of the offence.
