PROCEEDS OF CRIME (RECOVERY AND MANAGEMENT) ACT
Section 41: Setting aside a disposition contravening a restraint order.
1 The relevant organisation may apply to the Court to set aside a disposition or dealing with a property that contravenes a restraint order, where that disposition or dealing was not—
a for sufficient consideration; or
b in favour of a person, who acted in good faith.
2 The relevant organisation shall give to each party to the disposition or dealing, written notice of both the application and the grounds on which it seeks the setting aside of the disposition or dealing.
3 The Court may set aside the disposition or dealing and declare the rights of any person, who acquired interest in the property void.
