Section 106: Dispute Resolution

(1)
An employee or beneficiary of a Retirement Savings Disputes Account who is dissatisfied with a decision of the Pension Fund Resolution Administrator or employer in respect of pension matters under this Act, may request, in writing, that such decisions be reviewed by the Commission with a view to ensuring that such decision is made in accordance with the provisions of this Act or any regulation made there under.
(2) A copy of any request under sub-section (1) of this section shall be served on the relevant Pension Fund Administrator or employer.
(3)
The Commission shall in review a request of a Pension Fund Administrator or employer under sub-section (1) of this section, conduct its proceedings in such a manner as to avoid delay.
(4)
Notwithstanding sections 19(2)(a) and 26 (2) and (4) of this Act, where the Board of the Commission is not yet reconstituted after six months of the dissolution of the last Board, the President of the Federal Republic may appoint fit and proper persons with pension cognate experience to constitute the Board at the first instance, subject to the confirmation by the Senate.
