Section 87: Limitation of liability of the Authority in connection with pilotage
(1)
The Authority, in relation to its duties in connection with pilotage under Part X of this Act or any regulations made thereunder, shall not, where without its actual fault or privity, it causes any loss or damage to--
(a) a ship or merchandise or any other thing whatsoever on board a ship; or
(b)
any other property or right of any kind, whether on land or on water or whether fixed or movable, be liable to damages beyond the amount of N10,000 multiplied by the number of Authority and licensed pilots entitled to pilot ships in the pilotage district, where the loss or damage occurred on the date when the loss or damage occurred .
(2)
Nothing in this section shall be construed to impose a liability on the Authority for any loss or damage as specified in subsection (1) of this section, where no liability would have existed but for this section.
