Section 16: Power to borrow

1999Section 16 of 37Federal Republic of Nigeria

(1) The Agency may, from time to time, borrow by overdraft or otherwise, such sums as it may require for the performance of its functions under this Act.
(2) The Agency shall not, without the approval of the President, borrow money which exceeds at any time the limit set by the President.
(3) Notwithstanding subsection (1) of this section, where the sum to be borrowed is in
foreign currency the Agency shall not borrow the sum without the prior approval of the
President.
(4) The Board may, with the approval of the Minister, borrow on such terms and conditions, such sums of money as the Board may require in the exercise of the functions
conferred on it under this Act.
(5) The Board may, subject to the provisions of this Act and the conditions of any
trust created in respect of any property invest all or any of its funds with the approval of
the Minister or in accordance with any general guidelines approved by the President.
(6) The Board may invest any surplus funds in such securities as may be approved by
the Minister.
