Section 9: Penalty for concealment of Nigerian ship or assumption of foreign character

(1)
If the master or owner of a ship which is owned wholly by persons qualified to own a registered Nigerian ship does anything or permits anything to be done or carries or permits to be carried, any papers or documents, with intent to:
(a)
conceal from any person who is under the law, entitled to inquire into the fact that the ship is a ship owned wholly by persons qualified to own a registered Nigerian ship; or
(b) assume a foreign character; or
(c)
deceive any person so entitled to inquire into the ownership of the ship, the ship shall be liable to forfeiture under this Act.
(2)
The master of a ship which is liable to forfeiture under subsection (1) of this section, if he commits or is privy to the commission of the offence, shall on conviction be liable to a fine not less than five hundred thousand Naira or to imprisonment for a term not less than two years or both.
