Section 438: Applied legislation. First Schedule Cap 123

2007Section 438 of 445Federal Republic of Nigeria

(1)
The subsidiary legislation contained in the First Schedule to this Act to the extent only to which it is in force on the commencement of this part of this Act and anything to the contrary in the Interpretation Act or any other Act notwithstanding, shall be deemed to have been made under this Act and have effect accordingly.
(2)
The subsidiary legislation shall be read subject to such alterations therein as local circumstances render necessary and to any variations, revocations or suspensions made by subsidiary legislation under the appropriate provisions of this Act.
(3)
The Minister may, from time to time, by Order amend the First Schedule to this Act.
(4)
For the avoidance of doubt, references in any applied subsidiary legislation to "seaplanes" shall, unless the context otherwise requires, be construed as references to "aircraft" under this Act.
