Section 325: Forfeiture of dangerous goods

(1)
Where dangerous goods have been sent by or carried in any ship in a manner that would constitute an offence under this part of this Act, the court may order the goods, and any packaging or container thereof, to be forfeited.
(2)
A court may exercise the powers conferred by subsection (1) above notwithstanding-
(a)
that the owner of the goods concerned has not committed any offence in respect of the goods, or is not before the court, or has had no notice of the proceedings; and
(b)
that there is no evidence to show to whom the goods belong, but the court may, in its discretion, require such notice as it may direct to be given to the owner or shipper of the goods before they are forfeited.
