Section 17: Report of occupationality acquired HIV infections to the minister

(1)
Every employer shall ensure that all occupationally acquired HIV infections are reported to the Minister from the date of discovery.
(2)
It is an offence for an employerto fail to comply withthe provisions of subsection (l) of this section, or to knowingly or recklessly make any statement or produce any document that is false in any material particular unless such employer shows that he had taken all reasonable steps to ascertain the truth of the statement made or contained in any document so produced or to satisfy itself as to the genuineness of any sueh document.
(3)
An employer who contravenes subsection (2) ofthis Section commits an offence and is liable on conviction to a fine of not less than N250,000.00 or to imprisonment for a period not exceeding one year or to both such fine and imprisonment.
(4)
To protect the confidentiatity of the infected employee' the report shall be sent directly from employer to a designated Desk Officer at the Office of the relevant Minister.
