Section 105: Limitation of action against the Authority.

(1) Notwithstanding anything contained in any other law or enactment, no action shall lie against the Authority, a member of the Board, the Director-General or any other employee of the Authority, in the execution of any public duty under this Act or any law, or in respect of any alleged negligence or default in execution of any public duty under this Act or such law, unless it is commenced within three months next after the act, negligence, or default complained of, or in the case of continuance of damage or injury, within one year after the ceasing of it.
(2) A suit shall not be commenced against the Authority, a member of the Board, the Director-General or any other employee of the Authority before the expiration of a period of one month after written notice of intention to commence the suit shall have been served upon the Authority by the intending plaintiff or his agent; and the notice shall clearly and explicitly state the cause of action, the particulars of the claim, the name and place of abode of the plaintiff and the relief sought.
(3) An action shall not lie against the Authority, a member of the Board, the Director-General, or any other employee of the Authority for an act done in pursuance or execution of the powers conferred upon the Authority in respect
of any decision taken on matters relating to safety and security of civil aviation or in execution of any of the provisions of this Act.
