Section 38: Transactions to be in accordance with Act.

(1) Unless otherwise prescribed by this Act, every transaction of what nature soever in any State involving the use of any weight or measure not in accordance with this Act shall be void, and any person who uses any such weight or measure shall be guilty of an offence against this Act.
(2) All tolls and duties charged or collected according to weight or measure shall be charged and collected according to one of the weights or measure under this Act or to some part or multiple thereof.
