PUBLIC ENTERPRISES REGULATORY COMMISSION ACT
Section 35: Removal of auditors.
(1) An auditor may be removed by the directors of the public enterprise before the expiration of his term of office, notwithstanding anything in any agreement between the parties.
(2) A public enterprise which removes an auditor has been removed under subsection (1) of this section, shall within thirty days of the removal give notice of that fact in the prescribed form to the Commission.
(3) A public enterprise Which fails to give the notice required by subsection (2) of this section, and every officer of the public enterprise who is in default is guilty of an offence and liable to a penalty of N500 for every day during which the default continues.
(4) Nothing in this section shall be construed as depriving an auditor removed by a public enterprise of compensation or damages payable to him in respect of his removal as auditor or of any appointment as auditor.
