Section 37: Intervention.

The Commission may exercise the powers of intervention specified in sections 38, 39, 40 and 41 of this Act if-(a) it considers the exercise desirable for protecting policy holders or potential policy holders of an insurance institution, against the risk that the insurance institution may be unable to meet its liabilities or fulfill the reasonable expectations of policy holders or potential policy holders; or
(b) it appears to the Commission that the insurance institution has failed to satisfy an obligation to which it is subject by virtue of this Act; or
(c) it appears to the Commission that the insurance institution has furnished misleading or inaccurate information to the Commission under this Act or the Insurance Act; or
(d)
there exists such other condition or circumstance, as the Commission may determine, which makes it necessary for the Commission to exercise any of those powers.
