Section 43: when a person is treated as convicted.
For the purpose of section 45, a person is not treated as convicted unless-(a) as at the time the conviction is subsisting, no appeal is pending in an appellate court; or
(b) an appeal or further appeal is brought in connection with the conviction and the appellate court upheld the conviction, provided that such notice of appeal is brought within 60 days after the date of conviction.
