Section 41: Transfer of liability to contribute in the case of mergers, acquisitions, etc.

Where, under section 100 of the Investment and Securities Act, an order is made by a court under subsection (3) of that section which include the transfer to the company of the whole or any part of the undertaking and of the property and liabilities of a transferor company, the order shall include provisions for the taking over, as from such date as may be specified in the order, of any liability for any contribution which has become due and payable under the Scheme (together with any accrued interest thereon) in respect of the employees concerned in the undertaking, property or liability transferred.
