Section 78: Registry of transfer

(1)
Where a ship registered in Nigeria or any share in the ship, is transferred, the transferee shall not be registered as owner of this ship or share until he or in the case of a corporation, the person authorised by this Act to make declarations on behalf of the corporation, makes and signs a declaration referring to the ship, (in this Part referred to as a "declaration of transfer")

A declaration of transfer shall be in the form approved by the Minister.

Every bill of sale for the transfer of a ship registered in Nigeria, or a share in the ship shall, when duly executed, be produced to the Registrar at the ship port's of registry, with the declaration of transfer; and the Registrar shall upon the production, enter in the register the name of the transferee as the owner of that ship or share, and shall endorse on the bill of sale the fact that the entry has been made, with the date and time of the entry.

Bills of sale of a ship, or of a share in the ship shall be entered in the register in the order of their production to the Registrar.
