Section 430: Appeal to court
(1)
An appeal shall lie from a decision of the Marine Board to the court in the case of an investigation into the conduct of a holder or a certificate of competency granted under this Act.
(2)
The court in its discretion may determine the case or remit the case for rehearing generally or in part to the Marine Board.
(3)
The court shall remit a case-
(a)
if any new and important evidence which was not produced at the investigation or enquiry is discovered; or
(b)
if for any other reason there is ground for suspecting that a miscarriage of justice has occurred.
(4)
Subject to the terms of any order of the court, where no application for rehearing is made or a re-hearing is refused, the former holder of the certificate of competency may apply to the Minister and the Minister in his discretion may direct the re-issue and return of the certificate, or may direct the grant of another certificate of the same or a lower grade.
