Section 165: Property of seaman who dies during voyage

(1)
If any seaman or cadet who belongs to a Nigerian ship, the crew of which is to be discharged in or the final port of destination of which is in Nigeria, dies during a voyage, the master of the ship shall take charge of the money or effects belonging to the seaman or cadet on board the ship.
(2)
The master may, if he thinks fit, cause any of the effects to be sold by auction at the mast or otherwise by public auction.
(3)
The master shall enter in the official log-book the following particulars:
(a)
a statement of the amount of the money and a description of the effects;
(b)
in the case of a sale under subsection (2), a description of each article sold, and the sum received for each; and
(c)
a statement of the sum due to the deceased as wages, and of the amount of deductions, if any, to be made from the wages.
(4)
The entry in the official log-book shall be signed by the master and attested to by a mate and any other member of the crew.
(5)
The money, effects and balance of wages mentioned in subsections (1) to (4) of this section are in this part of this Act, referred to as the "property of the seaman or cadet".
