JUDICIAL OFFICERS (EXTENSION OF PERIOD OF SERVICE) ACT
Section 1: Extension of office of judges appointed under repealed enactments.
(1) Notwithstanding the provisions of any of the enactments specified in column 1 and operating in the States specified in column 3 of the Schedule to this Act or any other enactment which provide that any person holding the office of a Judge of the Federal High Court or the High Court of the State or the Grand Kadi or Kadi of a Sharia Court of Appeal of a State, shall vacate that office when he attains the age of sixty-two years; any Judge appointed under any of the enactments aforesaid shall continue to hold that office until he attains the age of sixty-five years.
(2) The amendment effected by this Act shall operate to validate anything duly done or having effect as if so done by a judicial officer affected by this Act on any date between the date when such judicial officer would but for this Act, have been required to vacate his office and the date of the making of this Act; accordingly the appointment of any such judicial officer shall be construed and have effect as if it was at all material times duly made under and the judicial officer vested with all the relevant powers of a judicial officer appointed under the Constitution of the Federal Republic of Nigeria or any other applicable law.
Section 2: Interpretation.
In this Act, "judicial officer" has the meaning assigned to it in section 277(1) of the Constitution of the Federal Republic of Nigeria.
Section 3: Short title.
This act may be cited as the Judicial Officers (Extention of Period of Service) Act.
