Section 52: Duty to notify capital market operator or person to be affected.
(1) No order under sections 48 and 51 of this Act shall be made unless the capital market operator in respect of which the order is to be made, and in the case of an order under paragraph (c) or (d) of subsection (2) of section 48 of this Act, the director, manager or officer who is to be removed from office, has been given a reasonable opportunity of making representations against or otherwise in respect of the proposed order.
(2) The Commission, after due consideration of any representation made pursuant to subsection (1) of this section, may either confirm, modify, alter, vary or replace the earlier order in respect of which representation had been made.
