Section 4: Offences under Military law.

(1) A fugitive criminal may be surrendered notwithstanding that the Attorney-General or a court dealing with the case is satisfied that the offence constitutes an offence only under military law or law relating only to military obligations.
(2) In this section, a court dealing with the case "in relation to a fugitive criminal" means any magistrate dealing with the fugitive's case in pursuance of section 8 of this Act or any court before which the fugitive is brought on by virtue of an application made by him or on his behalf for a writ of habeas corpus.
