Section 45: Conditions

The Council shall not approve a substitution pursuant to subsection 44 (1) of this Act unless the Council is satisfied that-(a) the process to be substituted includes a consideration of the factors referred to in section 11 of this Act;
(b) the public has been given an opportunity to participate in the assessment;
(c) at the end of the assessment, a report has been submitted to the Council; and
(d) the report has been published.
