Section 128: Officers who are to act as appropriate superior authority
(1) The following persons may act as appropriate superior authority in relation to a person charged with an offence, that is-
(a) the commanding officer; and
(b) any officer of the rank of brigadier or above or officer of corresponding rank or those directed to so act under whose command the person is for the time being.
(2)
The President may make rules for the purpose of this section and those rules may confer on the appropriate superior authority power to delegate his functions in such cases and to such extent as may be specified in the rules, to officers of a class so specified.
