Section 209: Separate charges for distinct offences

For every distinct offence with which a defendant is accused, there shall be a separate charge and every charge shall be tried separately except in the following circumstances:(a) any three offences committed by a defendant within 12 months whether or not they are of the same or similar character or whether or not they are in respect of the same person or persons; or
(b) any number of the same type of offence committed by a defendant; or
(c) any number of offence committed by a defendant in the course of the same transaction having regard to the proximity of the time and place, continuity of action and community of purpose; or
(d) cases mentioned in sections 210 to 215 of this Act.
